What a stupid judge. So this guy is too short to go to jail, yet wasn't too short to offend sexually? Bah!

My hubby says that if the guy is too short to go to jail now, and is put on probation, what happens if he violates that probation, doesn't he go to jail?
Then the guy has set a precident of "if I was too short then, I'm still too short".
